What is a sworn translation?

Sworn translations (also known as official or certified translations) are done by professionals – known as Certified Technical Consultants – who are enrolled in a special Court Register. Once the document has been translated, these professionals swear before a public official that the translation was done accurately and faithfully, assuming responsibility for their work.

When is a sworn translation recommended?

A sworn translation is recommended when the text needs to have an official value. In other words, when the text is to be submitted to a public body or a public authority (a municipality, a university, a public register, etc.). In these cases, the official translator goes before the court, by appointment, and swears the accuracy of the translation, signing an oath in the presence of a judicial official. Sworn translations at the Court of Florence require a duty stamp of 16 euro to be affixed for every 4 sheets of each document. These duty stamps are not required for documents concerning separations (art.19 of Italian law 74/1987) and international adoptions (art.82 of Italian law 183/1984).

HOW SHOULD DOCUMENTS BE SUBMITTED FOR TRANSLATION?

Documents coming from overseas
Generally, documents must be in the original or an authenticated copy. Often, the document’s prior legalisation is required which, depending on the country, is done using a visa issued by the overseas official or with a Hague Apostille. Legalisation is nothing more than a stamp which certifies that the signature of the person issuing the document is authentic. Usually, this operation is done through a power of attorney or by the Prefecture of reference.

Documents from Italy
The original document or an authenticated copy is also needed in this case and, depending on the situation, an Apostille may be required too (or a legalised document depending on which country the document is to be sent to). Some documents require a second legalisation step to recognise the signature of the judicial official before whom the translator has sworn the accuracy of the translation.
